Nominated Victorian Nationals MP Luke O’Sullivan could be forced to wait until October before being sworn into Parliament after his legal challenge against the Premier was adjourned last week.
Mr O’Sullivan is trying to force Premier Daniel Andrews and the government to ratify his appointment to fill a casual upper house vacancy for the Northern Victoria region, which includes Swan Hill.
The case was heard in the Victorian Supreme Court last Friday, but has been adjourned until September 27 to allow the government to “gather more information”.
The position was made vacant after former MP Damian Drum successfully sought the federal seat of Murray.
The government has refused to a hold a joint parliamentary sitting to swear in Mr O’Sullivan until the government’s upper house leader, Gavin Jennings, returns from a six-month suspension.
