The Victorian Nationals’ new upper house MP, blocked from taking his seat in Parliament, is taking his case to the Supreme Court today.
Luke O’Sullivan was pre-selected as the member for Northern Victoria to replace Damian Drum, who quit state politics to successfully take the federal seat of Murray.
The Coalition said two blocked motions last week to hold a joint sitting of Parliament, required to swear in a new MP, was retaliation for a six-month ban imposed by the upper house on the leader of the house Gavin Jennings.
After seeking legal advice, Mr O’Sullivan’s lawyers wrote to Premier Daniel Andrews last week, informing him of his constitutional duty to hold a joint sitting of the Parliament.
Mr O’Sullivan is now seeking to compel the Premier to hold a joint sitting next week.
