Application for bottle shop withdrawn

AN application for a new bottle shop in Swan Hill has been officially withdrawn ahead of significant changes to Victoria’s planning regulations.

The proposal, submitted by the company ‘I Can Smell a Dead Duck Ltd,’ sought to establish a packaged liquor outlet at the former Forty Winks site on Campbell Street.

The application quickly drew criticism from locals, with one resident launching a petition titled, ‘Stop the Bottle Shop’.

As part of planning requirements, the company had also lodged a planning permit with Swan Hill Rural City Council.

Mayor Cr Stuart King said in March: “The application for the liquor licence is not a council process, that’s direct with the liquor licensing authority”.

In a statement issued on Thursday, Cr King confirmed that the applicant has withdrawn the planning application.

“Council wishes to advise the community that the applicant for the packaged liquor licence planning application at 37–39 Campbell Street, Swan Hill, has formally withdrawn their application,” Cr King said.

This move comes in advance of a state government-initiated amendment, due to take effect on July 1, 2025.

Under this change, Clause 52.27 (Licensed Premises) will be removed from the Swan Hill planning scheme.

“Approval for licensed premises will no longer be determined under local planning controls but instead at a State level,” Cr King said.

“Council acknowledges the strong community interest in this application and the level of feedback received throughout the process.”

“We extend our sincere thanks to all residents, business owners, and community members who took the time to share their views, provide formal submissions, and engage constructively with Council.”

While the application has been withdrawn, Council has reminded the public that all future liquor licence matters will be decided by the Victorian Liquor Commission for Gambling and Liquor Regulation.
