A DEVELOPER has avoided having to seal a road in Nyah West where he plans to subdivide land in a win against Swan Hill Council.

The developer took the council to the Victorian Civil and Administrative Tribunal to review the decision to apply conditions to a planning permit for 15 Donald Street.
